1. Acceptance of Terms

2. Services Provided

Blue Rock Landscaping LLC provides landscaping and outdoor maintenance services, including but not limited to:

  • Irrigation system setup and repair

  • Seasonal cleanup

  • Landscape lighting

  • General outdoor consulting and strategy services All services are customized per client agreement.

3. No Guarantee of Specific Growth

While we strive for excellence, the Client acknowledges that outdoor environments vary. Blue Rock Landscaping LLC does not guarantee:

  • Specific growth rates for plants or sod

  • 100% prevention of pests or weeds

  • Survival of plants under extreme weather conditions or improper client care

  • Timeline for natural maturity of landscaping projects

4. Payment Terms

  • Services are billed as agreed upon in the service contract.

  • All payments are non-refundable once services are rendered.

  • Late payments may result in suspension or termination of ongoing maintenance.

  • Client agrees not to initiate chargebacks without first contacting Blue Rock Landscaping LLC in good faith.

  • Client remains responsible for all fees incurred prior to termination.

5. Minimum Commitment (If Applicable)

Recurring maintenance services may require a minimum commitment period as specified in the service agreement. If a minimum term applies, the Client remains financially responsible for the full term.

6. Intellectual Property

  • Client owns the final physical landscape installation after full payment.

  • Blue Rock Landscaping LLC retains ownership of proprietary design plans, digital mockups, and internal strategy frameworks unless otherwise agreed in writing.

7. Third-Party Platforms

We may utilize third-party platforms including, but not limited to:

  • Google

  • Meta (Facebook/Instagram)

  • WhatsApp

  • CRM software

  • Hosting providers Blue Rock Landscaping LLC is not responsible for platform outages, account suspensions, or policy updates from these third parties.

8. Limitation of Liability

To the maximum extent permitted by law, Blue Rock Landscaping LLC shall not be liable for:

  • Damage to underground utilities not clearly marked by the homeowner or utility companies

  • Indirect, incidental, or consequential damages

  • Natural wear and tear of outdoor materials Total liability shall not exceed the amount paid to the Company within the thirty (30) days preceding the claim.

9. Indemnification

Client agrees to indemnify and hold harmless Blue Rock Landscaping LLC from any claims, damages, or legal fees arising from client-provided site specifications, hidden property hazards, or regulatory violations related to property lines.

10. Dispute Resolution & Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in the State of California. Client agrees to waive the right to participate in class action lawsuits.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of California.

12. Modifications

Blue Rock Landscaping LLC reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the revised Terms.
